Conditions of Carriage

The carriage of passengers on flights by Gridiron Air LLC (“Gridiron Air”) is subject to the terms and conditions contained in these Conditions of Carriage and applicable law. By accepting air transportation on Gridiron Air, each passenger agrees to be bound by the terms and conditions of these Conditions of Carriage. Gridiron Air reserves the right to revise these Conditions of Carriage at any time in its sole discretion, without prior notice.
General
- Gridiron Air provides air transportation under charter agreements entered into with its customers. These Conditions of Carriage are incorporated by reference in such charter agreements. Gridiron Air is not responsible for any agreements or processes under which its customers arrange with passengers to travel on Gridiron Air flights. As between passengers and Gridiron Air, these Conditions of Carriage constitute the entire agreement.
- No purported alteration, modification, or waiver of any provision of these Conditions of Carriage is valid unless authorized in writing by a corporate officer of Gridiron Air.
Compliance with Laws
- Air transportation on Gridiron Air is performed subject to compliance with all applicable government laws, rules, regulations, and requirements, including but not limited to those of the U.S. Department of Transportation, U.S. Federal Aviation Administration, U.S. Transportation Security Administration, and U.S. Customs and Border Protection.
- By accepting air transportation on Gridiron Air, the passenger agrees to adhere to, and to assist Gridiron Air in adhering to, all applicable government laws, rules, regulations, and requirements, including but not limited to those of the U.S. Department of Transportation, U.S. Federal Aviation Administration, U.S. Transportation Security Administration, and U.S. Customs and Border Protection.
- No liability shall attach to Gridiron Air if Gridiron Air in good faith determines that what it understands to be applicable law, government regulation, demand, order, or requirement, requires that Gridiron Air refuse and Gridiron Air does refuse to carry a passenger.
Screening of Passengers and Baggage
- Passengers and/or their baggage are subject to security screening, including but not limited to security profiling, physical pat-downs and inspections, x-ray screening, manual bag searches, questioning of passengers, and use of electronic or other detectors or screening or security devices, in the sole discretion of the government, airport, or Gridiron Air, and with or without the passenger’s presence, consent, or knowledge.
- Neither Gridiron Air nor its employees or agents is liable for any damage, loss, delay (including refusal to transport), confiscation of property, injury, or other harm relating to or arising out of security screening conducted by an agent of the airport or any governmental agency or a passenger’s failure to submit to or comply with such security screening.
Seating
- Gridiron Air reserves the right to assign or re-assign seats at any time, even after a passenger boards the aircraft. This may be necessary for operational, safety, government regulatory, health, or security reasons. Gridiron Air will make reasonable seating accommodations for passengers with disabilities in accordance with applicable law.

Baggage amounts and sizes
- On all flights, Gridiron Air accepts a maximum of two checked baggage items for each passenger, in addition to one carry-on bag, plus one personal item such as a purse, briefcase, laptop/computer (which must be carried on board and cannot be checked) or an item of a similar size or smaller size to those listed.
- Each carry-on item shall not exceed 22" in height, 14" in length or 9" in width.
General Limitation of Liability for Loss of, Damage to, or Delay in Delivery of Baggage (Domestic Flights)
- Gridiron Air’s liability for loss of, damage to, or delay in delivery of a passenger’s personal property, including baggage, when such personal property or baggage has been checked is limited to USD 3,800 per ticketed passenger. The passenger will be responsible for documenting and proving the actual value of the loss. For baggage claims, reimbursement for any expenses will be based upon proof of claim acceptable to Gridiron Air.
- Gridiron Air is not liable for baggage or other items carried in the passenger compartment of the aircraft or that a passenger may leave at airports.
- If a passenger chooses to pack high value, fragile, or perishable items in checked bags, Gridiron Air is not liable for the loss of, damage to, or delay in delivery of such items, except as required by law.
- Gridiron Air is not liable for preexisting damage (including minor cuts, scratches, and broken zippers as a result of over packing) or for wear and tear resulting from ordinary handling of baggage.
- In the case of loss of, damage to, or delay in delivery of a passenger’s personal property, including baggage, a preliminary notice of claim must be submitted to Gridiron Air by the passenger within 24 hours after arrival of the flight on which the baggage was transported or was to be transported. Gridiron Air may deny any claim not presented within 24 hours.
- The completed written claim form pertaining to the claimed loss of, damage to, or delay in delivery of a passenger’s personal property, including baggage, must be received by Gridiron Air from the passenger within 30 days after the flight date. If the passenger fails to return the completed written claim form within the specified time period (absent extraordinary circumstances to be determined at Gridiron Air’s discretion), Gridiron Air shall have no further liability.

- For international travel, the Warsaw Convention and the Montreal Convention govern liability for personal injury, death, or damage. The terms and conditions set by these international conventions are not subject to change or modification by Gridiron Air. These conventions set compensation amounts for death, injury, and baggage loss and damage. These terms and conditions are accessible here and are incorporated by reference into these Conditions of Carriage.

Passengers with Disabilities
- Gridiron Air complies with 14 CFR part 382 (“Nondiscrimination on the Basis of Disability in Air Travel”), as issued and amended from time to time by the U.S. Department of Transportation.
- A passenger with a disability needing special services is encouraged to contact Gridiron Air as early as practicable in advance of travel to coordinate such services.
- For some special services, Gridiron Air may require advance notice to the extent permitted by law. Special services for which Gridiron Air requires at least 48 hours advance notice include:
- Transportation for an electric wheelchair on an aircraft with fewer than 60 seats);
- Provision of hazardous materials packaging for batteries or other assistive devices that are required to have such packaging;
- Accommodation for a group of ten or more qualified individuals with a disability, who make reservations and travel as a group;
- Provision of an on-board wheelchair on an aircraft with more than 60 seats that does not have an accessible lavatory;
- Accommodation of a passenger who has both severe vision and hearing impairments;
- Use of the passenger’s own ventilator, respirator, continuous positive airway pressure (CPAP) machine, or personal oxygen concentrator (POC); and
- Transportation of a service animal in the cabin (unless the passenger’s travel has been arranged less than 48 hours prior to departure).

Service Animals
- To the extent required by U.S. Department of Transportation regulations (14 CFR part 382), Gridiron Air accepts for transportation, without charge, service animals that have been trained to do work or perform tasks to assist a passenger with a disability who is traveling on the flight. The animal will be permitted to accompany the passenger in the cabin, subject to the conditions stated here that are incorporated by reference into these Conditions of Carriage.
- To the extent required by U.S. Department of Transportation regulations (14 CFR part 382), Gridiron Air accepts for transportation, without charge, service animals that have been trained to do work or perform tasks to assist a passenger with a disability who is traveling on the flight. Acceptance/Refusal of Passengers
- Gridiron Air may refuse to transport any passenger, and may remove any passenger from its aircraft at any time, for any of the following reasons:
- When necessary to comply with any law, regulation, or government directive, or request;
- When advisable in Gridiron Air’s sole discretion due to weather or other conditions beyond Gridiron Air’s control including Acts of God, strikes, civil unrest, embargoes, war, and other similar matters of force majeure;
- When a passenger refuses to permit search of his person or property for explosives, weapons, dangerous materials, or other prohibited items;
- When a passenger refuses to produce positive identification on request;
- When a passenger fails or refuses to comply with any of Gridiron Air’s rules or regulations, or any term of the Conditions of Carriage;
- When refusal to transport or removal of the passenger is reasonably necessary in Gridiron Air’s sole discretion for the passenger’s comfort or safety, for the comfort or safety of other passengers or Gridiron Air employees, or for the prevention of damage to the property of Gridiron Air or its passengers or employees. By way of example, and without limitation, Gridiron Air may refuse to transport or may remove passengers from its aircraft in any of the following situations:
- When the passenger’s conduct is disorderly, abusive, or violent;
- When the passenger appears to be intoxicated or under the influence of drugs;
- When the passenger is barefoot;
- When the passenger interferes with the flight crew’s activities, or fails to obey the instruction of any member of the flight crew;
- When the passenger has a contagious disease that may be transmissible to other passengers during the normal course of the flight;
- When the passenger is unable to sit in a seat with the seatbelt fastened;
- When the passenger’s behavior may be hazardous or creates a risk of harm to the passenger, the crew, or other passengers or to Gridiron Air’s aircraft and/or property, or the property of other passengers;
- When the passenger is seriously ill, unless the passenger provides a physician’s written permission to fly; or
- When the passenger’s conduct, attire, hygiene, or odor creates an unreasonable risk of offense or annoyance to other passengers.
- Gridiron Air may refuse to transport any passenger, and may remove any passenger from its aircraft at any time, for any of the following reasons:
Delays/Cancellations
- Unless otherwise provided under an agreement or except as otherwise required by law, Gridiron Air is under no obligation to provide any compensation, amenities, or benefits to passengers in the event of a flight delay or cancellation.

Immigration and Customs Regulations
Personal Data
- By providing personal information for purposes of air transportation on Gridiron Air, the passenger authorizes Gridiron Air to retain such information, to use it to provide air transportation and related services and facilities, and to disclose it as required by law, regulation, or court order, at government or law enforcement request, or in a good faith belief that disclosure is necessary or advisable.

Customer Behavior
- Customers are required to act in a lawful and responsible manner while on the aircraft and comply with the instructions of the pilot in command of the aircraft. All passengers are required to adhere to the passenger notices issued by Gridiron Air.
- Smoking, vaping, or any other form of tobacco use is not permitted on any Gridiron Air aircraft.
- Passengers are not permitted to consume alcohol onboard the aircraft unless it has been served to them by Gridiron Air.
- Passengers are not permitted to transport or use illegal drugs or marijuana onboard the aircraft.
Governing Law / Jurisdiction
To the extent not preempted by federal law, these Conditions of Carriage shall be governed and construed in accordance with the laws of the State of New York, USA, without regard to its conflicts of laws rules.
Limit of Liability
Unless specifically stated otherwise herein or where any limitation would expressly violate any applicable law, Gridiron Air is not liable for special, consequential, indirect, or incidental damages that arise from these Conditions of Carriage and/or the passenger’s use of or dealings with Gridiron Air, even if Gridiron Air knew, should have known, or was advised that damages were possible, including from lost, damaged, or delayed bags (including lost revenue or business interruption).
Class Action Waiver
Any lawsuit a passenger brings against us, or any of our affiliated entities, agents, directors, employees, and/or officers related to these Conditions of Carriage and/or the passenger’s use of or dealings with Gridiron Air will be brought only in the passenger’s individual capacity, and may not be brought in or asserted as part of a class action proceeding.
Waiver and Severability
Any failure by Gridiron Air to insist upon or enforce strict performance of any provision of these Conditions of Carriage shall not be deemed a waiver of any right or provision. If any provision of these Conditions of Carriage is held by a court of competent jurisdiction to be unenforceable, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Conditions of Carriage will continue in full force and effect.
